Ola Faro, a lawyer with Emmanuel Chambers, filed a petition alleging that lawyer and author Tomilola Farotimi, also known as Dele Farotimi, had made defamatory remarks about the Supreme Court and the legal profession in his book Nigeria and Criminal Justice System.
The request to revoke Farotimi's law practicing license was denied by the Legal Practitioners Disciplinary Committee (LPDC) due to allegations of professional misconduct and criminal defamation.
"The publication is an intellectual property and not a conduct or action committed while practicing as a Legal Practitioner. All aggrieved parties who find the publication 'defamatory' should ventilate their grievances through the regular courts," said Justice Isaq Usman Bello, the LPDC Chairman, explaining the committee's decision to rule that it lacked jurisdiction over the matter after concluding that the alleged offences occurred in Farotimi's capacity as an author rather than in his capacity as a lawyer.
According to reports, Farotimi's book made reference to suit number SC/146/2006, which involved HRH Oba Tijani Akinloye and Major Muritala Gbadamosi Eletu and others and claimed unethical and corrupt acts in the legal community and judiciary. According to Emmanuel Chambers, the book misrepresented case facts, denigrated other attorneys, and hindered justice for its own benefit.
In addition, the Chambers asked that Farotimi's name be removed from the Roll of Legal Practitioners after pointing out several infractions of the Rules of Professional Conduct for Legal Practitioners 2023. But in the end, the petition was unsuccessful due to the LPDC's jurisdictional restrictions.
